Terms and Conditions for Workshops
These Terms and Conditions (“Terms”) govern participation in workshops conducted by TRE® India (“Organizer”, “we”, “us”, or “our”). By registering for or attending any workshop, you (“Participant”, “you”, or “your”) agree to be bound by these Terms and any related policies published on our website or documents.
- Acceptance of Terms
By accessing or using the website www.treinindia.com and/or registering for a workshop, you acknowledge that you have read, understood, and agreed to these Terms, all applicable laws, and regulations. If you do not agree, you are not authorized to use this site or participate in the workshops.
- Workshop Registration and Payment
- Registration is confirmed only upon receipt of the full workshop fee.
- All payments must be completed prior to the commencement of the workshop.
- Failure to make payment within the stipulated time will result in cancellation of registration and forfeiture of your slot.
- Non-Refundable Policy
- All workshop fees are strictly non-refundable, regardless of the reason for non-attendance, withdrawal, or change in personal circumstances.
- Participants are advised to review all workshop details carefully before registration.
- In exceptional cases, such as organizer-led cancellation, TRE® India may, at its sole discretion, offer rescheduling options.
- Non-Transferable Policy
- Workshop registrations are non-transferable.
- Substitution or transfer of participation to another individual is not permitted under any circumstance Since it is a somatic practice.
- Workshop Schedule and Modifications
- TRE® India reserves the right to:
- Modify the schedule, venue, or facilitator of the workshop.
- Reschedule or cancel the workshop due to unforeseen circumstances such as low enrolment, natural disasters, or emergencies.
- Participants will be notified in advance wherever possible.
- No refunds or compensation will be provided for rescheduling or modification of dates.
- Code of Conduct
Participants are expected to:
- Maintain respectful, professional, and cooperative conduct during all sessions.
- Refrain from behaviour that is disruptive, unsafe, or disrespectful towards others.
The Organizer reserves the right to remove any participant whose behaviour is deemed inappropriate, without refund or compensation.
- Health and Safety
- Participants should consult their TRE Trainer before registering, if they have any pre-existing medical, mental health, or physical concerns.
- TRE® workshops may involve physical and emotional exercises. Participants are responsible for ensuring they are in suitable physical and mental condition to participate.
- TRE® India reserves the right to deny participation to individuals deemed medically unfit for the workshop.
- Liability Disclaimer
To the maximum extent permitted by law, TRE® India and its facilitators shall not be liable for:
- Any personal injury, loss, or damage sustained during or after the workshop.
- Any damage to personal property.
- Any impact on the participant’s physical, mental, or emotional health during or after participation.
Participants voluntarily assume all associated risks and agree to indemnify TRE® India from any claims arising from their participation.
- Intellectual Property
All workshop materials, content, recordings, and resources are the intellectual property of TRE® in India Shivaprasad Kumarswamy and Dr David Bercelli
- Participants may use the materials solely for personal learning and practice.
- Any reproduction, distribution, adaptation, or commercial use is strictly prohibited
- Modifications to Terms
TRE® India reserves the right to amend or update these Terms at any time without prior notice.
By continuing to use the website or participate in workshops after such changes, you agree to the revised Terms.
- Governing Law and Jurisdiction
These Terms shall be governed by and construed in accordance with the laws of India.
Any disputes arising from or relating to these Terms shall be subject to the exclusive jurisdiction of the courts of Bengaluru, Karnataka, India.
- Acknowledgement
By registering for and participating in any workshop, you acknowledge that you have read, understood, and agreed to be bound by these Terms and Conditions.
- Indemnity
Although it is safe to practice TRE® under the guidance of a certified TRE® Provider, as with any physical exercise or modality, certain safety precautions apply.
- TRE® is always taught in a safe and controlled manner to individuals and groups.
- TRE® is not intended to diagnose, treat, cure, or prevent any disease but serves as a safe and effective stress release technique for most people.
- The TRE® process should not be used as a substitute for medical or psychiatric/psychological treatment.
- Results may vary between individuals, as each person’s body, patterns, and experiences are unique. No guarantees, expressed or implied, are provided.
- Release of Liability
I understand that TRE® involves mild exercises that stretch and fatigue the psoas muscle to activate the body’s natural tremor/shaking mechanism.
- TRE® exercises are not high-performance or endurance training and are generally safe when performed under supervision.
- I acknowledge that I am voluntarily participating in TRE® sessions individual, online, or group at my own discretion and consent.
- I am aware that I can regulate and control the intensity of my tremor/shaking during practice.
- If I disregard safety instructions provided by my TRE® Trainer, I accept full responsibility for any resulting adverse effects.
I understand that while Shivaprasad Kumarswamy is a licensed Global TRE® Certification Trainer he is not a licensed medical doctor, and does not provide medical advice. I recognize that he does not recommend that I stop using prescribed medicine, treatments, or mental health counselling without consulting my doctor or counsellor
I agree to take full responsibility for my own physical and emotional well-being and hold Shivaprasad Kumarswamy harmless from any legal, financial, or medical liability arising from my negligence.
- Contraindications
Individuals with the following conditions should consult their TRE® Provider before participation to assess suitability:
- Serious physical or psychological conditions requiring strict regulation.
- Fragile psychological defences or complex trauma histories.
- Recent surgery (within 3 months), childbirth, or open wounds.
- Current pregnancy.
- History of epilepsy or seizures.
TRE® should not be practiced under these circumstances without prior consultation and clearance.
- Confidentiality
All discussions, interactions, and personal information shared during TRE® sessions are treated as strictly confidential. Your TRE® Provider will not disclose any information to third parties without your explicit consent, except where required by law. However, during group workshops, complete confidentiality cannot be guaranteed due to the shared setting. Participants are therefore encouraged to exercise discretion and share personal information only to the extent they feel comfortable and appropriate.
- Disclaimer on Data Use
All personal information, medical history, and indemnity details provided in this form are strictly confidential and will not be shared with any third party. This data will be used solely for internal records, workshop administration, and participant safety purposes by TRE® India.
- Non-Touch Policy:
TRE® India follows a strict non-touch policy during workshops. Facilitators and participants are expected to maintain professional boundaries at all times.
- Demonstrations where physical touch is necessary to explain or guide posture, or
- Medical or safety-related emergencies requiring immediate support.
In such situations, permission will be explicitly sought from the participant by the facilitator, and you may accept or decline based on your comfort and choice. Informed consent will always be obtained prior to any physical contact. Participants are requested to respect personal space and maintain appropriate boundaries throughout all sessions.
